Local Brewery Land Use and Trespass Case

The brewery was built in a commercial subdivision in Paso Robles. The crux of plaintiffs' lawsuit was allegations that defendants failed to obtain approval of their development from the subdivision's architectural review committee as required by the CC&Rs and that defendants altered an approved drainage easement, thereby creating a trespass by water. After a two-week trial, the Court rejected both of these allegations by plaintiffs.
Successful Defense of IRS Levy Attempt

One of the firm's principals successfully applied for a preliminary injunction on behalf of his client prohibiting the Internal Revenue Service from proceeding with its attempt to levy against plaintiff's property based on a federal estate tax lien totaling in excess of $1.7 million. The injunction issued and the Court directed the IRS to pursue the individual who actually owed the estate tax.
